Notice to the Electors of the City of Fairlawn for the Interim Appointment of an At Large Council

Due to the retirement of Mayor Roth, effective 12:01 AM December 1, 2022, Council President Russell T. Sharnsky moves into the position of Mayor, making it necessary that the interim vacancy on Fairlawn City Council be filled by appointment of Council.

Section 4.04 ‘VACANCIES” of Article IV “COUNCIL” of the Fairlawn Charter states: “Whenever the office of a Councilman shall become vacant for any reason, the vacancy shall be filled by a majority vote of all the remaining members of Council. If the Council shall not so fill such vacancy within thirty days after it has occurred, the power of Council to do so shall lapse and the Mayor shall make an appointment to fill such vacancy. Such appointee shall hold office for the unexpired term of the member in whose office the vacancy has occurred, or until the beginning of the term of a successor duly elected for the unexpired term at the next regular Municipal election if (a) such election shall occur two years or more prior to the expiration of the unexpired term, and (b) the vacancy shall have occurred more than 90 days prior to such election.”To be qualified for appointment as At Large Council person an individual must:For at least two previous years immediately prior to the date of appointment be a resident and qualified elector of the City of Fairlawn; (Charter Section 4.02) andA member of Council shall not otherwise be employed by the City of Fairlawn and shall hold no other public office, except as otherwise provided in the Charter of the City of Fairlawn or by ordinance enacted thereunder, than that of notary public or membership in the Ohio National Guard or Reserve Corps of the United States. (Charter Section 4.02) Individuals interested in applying for the interim appointment of an At Large Councilperson must submit a letter of qualifications together with petitions signed by a minimum of 25 electors of the City of Fairlawn to Tonja K. Caldwell, Clerk of Council, City of Fairlawn, 3487 South Smith Road, Fairlawn, OH 44333 on or before 4:00 PM Thursday, December 15, 2022.  Sample petitions may be obtained from the Clerk of Council between 8:00 AM and 4:00 PM Monday thru Friday at Fairlawn Municipal Building Offices, 3487 South Smith Road, Fairlawn, OH 44333, by email request to Caldwell@fairlawn.us, by phone request of Tonja Caldwell at 330-668-9513.
